1. Overview

This website is operated by Pubbets!, the business operating pubbets.net. Throughout these Terms, “Pubbets!”, “we”, “us” and “our” refer to Pubbets!.

These Terms of Service apply when you:

  • visit or use our website;
  • purchase a product or service from us;
  • commission a custom or premium puppet;
  • submit artwork, photographs, designs or other materials to us; or
  • use a Pubbets! puppet in performances, recordings or commercial content.

By using our website or placing an order, you agree to these Terms and any policies or order-specific terms referenced at checkout.

Separate written agreements may apply to affiliate programs, theatrical productions, character licensing, merchandising, wholesale arrangements, commissioned productions and other special projects. If a separate written agreement conflicts with these Terms, the separate agreement takes priority for that project.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

2. Eligibility and account information

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order.

You agree to provide accurate, current and complete contact, billing and delivery information. Please check your email address and delivery address carefully before submitting an order.

You are responsible for keeping your account and login details secure. Please notify us promptly if you believe your account has been accessed without permission.

3. Products and descriptions

Pubbets! offers several types of products, including:

  • factory-produced retail puppets;
  • Pubbets Lab customisable puppets;
  • Curated custom builds;
  • Masterworks and other premium one-off creations;
  • clothing, accessories and replacement parts; and
  • related creative products and services.

We make reasonable efforts to ensure product descriptions, photographs, dimensions, colours and prices are accurate.

Screen settings, lighting, fabric batches and the handmade nature of some products may result in minor differences in colour, texture, positioning or finish. These reasonable variations are part of the handmade process and are not necessarily defects, provided the product still substantially matches its description and any agreed specifications.

Lookalike puppets are stylised artistic interpretations. Unless we expressly agree otherwise in writing, they are not intended to be exact or photographic replicas of a person.

Product photographs may include clothing, props or accessories that are not included unless the product description says they are included.

4. Orders, acceptance and payment

Submitting an order is an offer to purchase the selected products under these Terms.

We may decline or cancel an order for reasonable grounds, including:

  • suspected fraud or unauthorised payment;
  • an obvious pricing or description error;
  • unavailable materials or stock;
  • legal or safety concerns;
  • an order that infringes another person’s rights; or
  • circumstances that mean we cannot reasonably complete the order.

If we cancel an order after receiving payment, we will provide a refund for any amount paid for goods or services that will not be supplied.

If a product has been displayed at an obvious and genuine pricing error, we may contact you before fulfilment and offer you the choice of paying the correct price or cancelling the affected item for a full refund.

Prices are shown in the currency displayed on the website or quotation. Currency conversion charges imposed by your bank or payment provider are your responsibility.

5. Custom, Curated and premium orders

5.1 Order specifications

Custom orders are produced using the selections, photographs, written instructions, approved build sheets and other information supplied or approved by you.

Please review all build information carefully. You are responsible for notifying us promptly if any important detail is missing or incorrect.

If order information is incomplete, we may pause the project while we request clarification. Delays caused by missing information, delayed approvals or requested changes may extend the estimated completion date.

5.2 Build sheets, concepts and approvals

Build sheets, illustrations, digital mock-ups and reference images are visual guides. The finished puppet will be a handmade interpretation of the approved concept.

Your approval allows us to proceed using the agreed specifications. Minor practical adjustments may be required during construction because of material availability, puppet movement, structural integrity or manufacturing limitations.

We will contact you before making a significant change that materially alters the agreed appearance or price.

5.3 Customer-requested changes

Changes requested after approval or after construction has begun may:

  • require additional materials or labour;
  • result in an additional charge; and
  • extend the completion date.

We will explain and obtain approval for any additional charge before proceeding with the requested change.

5.4 Materials and substitutions

Fabric, wigs, clothing and accessories may occasionally become unavailable.

If an agreed item is unavailable, we will offer a reasonably comparable alternative or discuss another solution with you. We will not knowingly make a substantial substitution without your approval.

5.5 Production timelines

Custom and premium products take time to design, source and build. Any completion or delivery date is an estimate unless we have expressly guaranteed a date in writing.

We will make reasonable efforts to meet the estimate and communicate material delays. Production times may be affected by order volume, customer approvals, material availability, project complexity, illness, carrier disruption and other circumstances outside our reasonable control.

If a delay becomes substantial, we will contact you to discuss the revised timing and any remedies available under applicable law.

6. Cancellations and changes of mind

6.1 Retail products

Please contact us as soon as possible if you wish to cancel a retail order.

If the order has not been dispatched, we may be able to cancel it. Once an order has been dispatched, any voluntary change-of-mind return is subject to the Returns Policy displayed on our website.

We are not required to provide a refund solely because you changed your mind, found an alternative product or no longer require the product, except where our Returns Policy says otherwise.

6.2 Custom and personalised products

Custom, Curated, Masterworks and personalised products are made or sourced specifically for you.

There is no automatic change-of-mind cancellation right once design work, material sourcing or construction has begun.

If you request cancellation after work has started, we may offer a partial refund at our discretion. Any amount retained will be reasonably calculated by reference to:

  • work already completed;
  • custom design time;
  • materials already purchased or committed;
  • non-refundable third-party charges; and
  • other reasonable costs directly incurred for the order.

This is not intended to operate as a penalty.

If we have not begun work or committed costs, please contact us and we will assess whether cancellation is possible.

This section does not limit your rights where a product or service fails to meet a consumer guarantee or where Pubbets! cannot supply the agreed order.

7. Shipping, delivery and customs

Shipping charges and available delivery methods will be displayed at checkout or included in your quotation.

Delivery dates are estimates unless expressly guaranteed in writing. International shipments may be delayed by customs processing, carrier disruption, weather, public holidays or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Please contact us immediately if an address needs to be changed. We cannot guarantee that an address can be changed after dispatch.

Unless expressly included at checkout, international customers are responsible for any import duty, customs charge, tax, clearance fee or other government charge imposed by the destination country.

If a parcel is returned because of an incorrect address, refusal, failure to collect or unpaid import charges, we may require payment of the reasonable cost of re-delivery. This does not apply where the return was caused by our error or a failure for which we are legally responsible.

Please contact us promptly if a parcel arrives damaged, appears to have been lost or contains the wrong item. Keep the packaging and provide photographs where possible so we can investigate with the carrier.

Nothing in this section limits any responsibility we have for delivery under applicable consumer law.

8. Consumer guarantees, faults and remedies

Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies.

These guarantees may include that goods:

  • are of acceptable quality;
  • are reasonably fit for any disclosed purpose;
  • match their description, sample or agreed specifications; and
  • are supplied within a reasonable time where no time has been agreed.

If a product or service fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, resupply or compensation, depending on the circumstances and seriousness of the failure.

A problem is not ordinarily a product failure where it was caused by:

  • abnormal use or misuse;
  • accidental damage after delivery;
  • failure to follow reasonable care or safety instructions;
  • unauthorised structural alteration;
  • ordinary wear and tear; or
  • information or specifications supplied incorrectly by the customer.

Please contact info@pubbets.net with your order number, an explanation of the problem and supporting photographs or video where appropriate. We may request reasonable proof of purchase.

These Terms do not replace or reduce any rights available under applicable law.

9. Ownership of the physical puppet

Once your order has been paid for and supplied, you own the physical puppet and any physical accessories included with it.

Ownership of the physical object does not automatically transfer copyright, trade marks, design rights, manufacturing patterns or other intellectual-property rights embodied in that object.

You may maintain, repair, alter and customise the physical puppet you own. You may also engage another person to repair or alter it for you.

You may not use the physical puppet to create manufacturing templates, production patterns or unauthorised copies for sale or distribution.

10. Pubbets! intellectual property

“Pubbets! Intellectual Property” includes our:

  • retail puppet and character designs;
  • original artwork and illustrations;
  • patterns, templates and manufacturing specifications;
  • construction methods and technical documentation;
  • photographs, videos, written content and graphics;
  • logos, names, trade marks and branding;
  • website content and software; and
  • original design contributions made during custom projects.

Unless expressly agreed otherwise in writing, Pubbets! retains ownership of all Pubbets! Intellectual Property.

Copyright and other intellectual-property rights are not transferred merely because you purchase a puppet, commission a custom build, provide creative input or purchase every puppet in a product range.

10.1 Retail puppets

Pubbets! retains the intellectual-property rights in its retail puppet and character designs.

You receive the usage licence described in Section 12, but you do not receive ownership of the underlying character design or the right to manufacture copies.

10.2 Custom and premium puppets

You retain ownership of the Customer Materials you provide to us.

Pubbets! retains ownership of its pre-existing materials, construction methods, patterns, technical processes and original design work created by Pubbets! unless a separate written agreement expressly assigns particular rights to you.

The purchase price for a custom puppet covers the physical puppet and the usage licence in Section 12. It does not include an assignment of copyright or other intellectual-property rights unless expressly stated in writing.

Your original scripts, names, storylines, dialogue, personalities and other creative material remain yours, subject to any Pubbets! Intellectual Property incorporated into them.

11. Customer materials and third-party rights

“Customer Materials” means photographs, drawings, logos, character designs, written instructions, names and other materials you provide for an order.

You retain any rights you hold in your Customer Materials.

You grant Pubbets! a non-exclusive, royalty-free licence to use, reproduce, adapt and share the Customer Materials only as reasonably necessary to:

  • assess and complete your order;
  • communicate with you about the project;
  • arrange manufacturing, tailoring or specialist work;
  • provide repairs or after-sales support; and
  • keep reasonable internal business and order records.

Providing Customer Materials does not automatically give us permission to use them publicly or in advertising.

You confirm that you own the Customer Materials or have permission to provide and use them for the project.

Please do not ask us to reproduce a copyrighted character, celebrity likeness, logo, uniform or other protected material unless you have the necessary rights or the proposed use is otherwise lawful.

We may decline, pause or modify a project if we reasonably believe it could infringe another person’s intellectual-property, privacy, publicity or other legal rights.

12. Standard puppet usage licence

When you lawfully purchase a Pubbets! retail or custom puppet, Pubbets! grants you a non-exclusive, worldwide, royalty-free licence to use that physical puppet for:

  • personal enjoyment and collection;
  • education, teaching, ministry and therapy;
  • live performances, including ticketed performances;
  • theatre, comedy, storytelling and puppetry shows;
  • photography, film, television and recorded media;
  • livestreams, podcasts and online videos;
  • monetised content on platforms such as YouTube, TikTok, Instagram and Facebook;
  • advertising, sponsored content and promotional videos; and
  • other lawful commercial content creation.

You do not need prior approval to perform with the puppet, create original content featuring it or earn money from that content.

Credit is not required, but “Puppet by Pubbets!” or similar credit is always appreciated.

This licence applies while you lawfully own the physical puppet. Content lawfully created during your ownership may remain published and monetised after you transfer the puppet to someone else.

If you sell or give the physical puppet to another person, the standard licence transfers to the new lawful owner. You may not sell or transfer broader rights than those granted in these Terms.

13. Uses requiring a separate written licence

The standard usage licence does not include the following rights.

13.1 Official or branded Pubbets! productions

You may not present a production, event, organisation or business as being produced, authorised, sponsored or officially endorsed by Pubbets! unless we have agreed in writing.

You may accurately describe a puppet as a Pubbets! puppet, but you may not use “Pubbets!” as the principal title, brand or identity of a production without permission.

13.2 Scripts and theatrical licensing

You may create and perform your own live production using puppets you own, including selling tickets to that performance.

However, a separate written agreement is required if you wish to:

  • market a production as an official Pubbets! production;
  • use Pubbets! or one of our retail characters in the title or principal branding;
  • publish or commercially distribute a script built around Pubbets! characters;
  • license or sublicense a Pubbets!-based play or format to other performers, theatres or schools; or
  • collect theatrical licensing or royalty income using Pubbets! Intellectual Property.

Purchasing some or all of our retail puppets does not itself grant theatrical licensing, franchise or royalty-sharing rights.

13.3 Merchandise

A separate written licence is required to manufacture or sell merchandise reproducing Pubbets! Intellectual Property or the likeness of one of our retail characters.

This restriction does not prevent ordinary promotional use such as photographs, video thumbnails, show posters, programs or advertising for a lawful performance.

The merchandising rights for a custom character will depend on who owns the underlying artwork and design contributions. Please contact us before producing merchandise so the rights can be confirmed in writing.

13.4 Reproduction and manufacturing

You may not scan, pattern, mould, reverse-engineer or otherwise reproduce a Pubbets! puppet for the purpose of manufacturing or distributing copies.

This does not prevent reasonable repairs, alterations or replacement of worn components on the physical puppet you own.

13.5 Trade marks and permanent brand identities

You may not register, claim ownership of or use Pubbets! names, logos or character branding as a trade mark, business name, domain name, social-media identity or permanent brand without written permission.

13.6 Digital replicas and artificial intelligence

A separate written licence is required to create or commercially distribute a stand-alone digital replica, game asset, virtual avatar, downloadable model or generative-AI training model based primarily on Pubbets! Intellectual Property.

This does not prevent ordinary filming, photography, animation or editing of lawful content featuring your physical puppet.

14. Creative freedom and brand safety

We encourage creative expression. Your content can be funny, serious, educational, religious, unusual, spooky, satirical or intended for adults.

However, the standard licence does not permit:

  • illegal activity;
  • infringement of another person’s intellectual-property, privacy or publicity rights;
  • fraudulent impersonation;
  • false claims of endorsement by Pubbets!;
  • content that promotes hatred or violence against a person or group based on a protected characteristic; or
  • use designed to deceive customers about the origin or manufacturer of a puppet.

Content created by customers is independent content. It is not produced or endorsed by Pubbets! merely because a Pubbets! puppet appears in it.

15. Reviews, photographs and user-generated content

You retain ownership of photographs, videos, reviews and other content you create.

If you deliberately submit content to us for publication, tag Pubbets! for the purpose of being featured, or use a campaign hashtag that clearly invites submissions, you grant us a non-exclusive, worldwide, royalty-free licence to reproduce, crop, resize, caption and share that content on:

  • our website;
  • our organic social-media channels;
  • email newsletters; and
  • other Pubbets! promotional channels.

We will not use a customer photograph or video in paid advertising merely because it was sent to us in connection with an order. Paid advertising use requires separate permission unless specific campaign, affiliate, competition or Content Club terms clearly provide otherwise.

By submitting a review for publication, you permit us to display and quote the review in connection with our products and business. We will not publish sensitive personal information such as your home address or private contact details.

You may ask us to stop using submitted content in future promotions by contacting info@pubbets.net. We will make reasonable efforts to stop new use, although we may not be able to recall printed material already distributed or campaigns already committed.

16. Unsolicited ideas and proposals

Please do not send confidential creative ideas, scripts, business proposals or character concepts unless we have agreed in writing to receive them confidentially.

If you send an unsolicited proposal:

  • you retain ownership of your material;
  • we are not required to keep it confidential;
  • we are not required to review, develop, return or pay for it; and
  • you give us a limited licence to review it internally and respond to you.

Pubbets! may already be developing, or may later independently develop, a similar idea. Similarity alone does not establish that your idea was copied.

This section does not give Pubbets! ownership of your unsolicited material or an unrestricted right to commercialise it.

17. Acceptable website use

You must not:

  • use the website for an unlawful or fraudulent purpose;
  • introduce malicious code, viruses or automated attacks;
  • attempt to bypass website security;
  • scrape or harvest customer information;
  • interfere with the website or another customer’s use;
  • submit false or misleading information;
  • use our content to create a competing product catalogue or counterfeit product; or
  • reproduce substantial parts of the website without permission.

We may restrict access where reasonably necessary to protect customers, our systems, our rights or the security of the website.

18. Third-party services and links

Our website may use or link to services operated by third parties, including Shopify, payment processors, social-media platforms and delivery providers.

Third-party websites and services have their own terms and privacy practices. We are not responsible for third-party content or services that we do not control.

This section does not exclude any responsibility Pubbets! has for a contractor or service provider where that responsibility cannot lawfully be excluded.

19. Privacy

We handle personal information in accordance with our Privacy Policy and applicable privacy law.

We use customer information to process orders, communicate about projects, arrange payment and delivery, provide support, prevent fraud and operate our business.

Payment information may be processed directly by Shopify or another authorised payment provider. Please refer to our Privacy Policy for further information.

20. Disclaimer and limitation of liability

Nothing in these Terms excludes, restricts or modifies:

  • the Australian Consumer Law;
  • any applicable consumer guarantee;
  • liability for fraud, wilful misconduct or personal injury where it cannot lawfully be excluded; or
  • any other right or remedy that cannot lawfully be excluded.

To the extent permitted by law, Pubbets! is not responsible for loss or damage caused by:

  • misuse, abnormal use or unauthorised modification of a product;
  • inaccurate information supplied by the customer;
  • unlawful content created by a customer;
  • failure to follow reasonable care or safety instructions;
  • third-party services outside our reasonable control; or
  • circumstances that were not reasonably foreseeable.

Where the law permits liability to be limited, our liability will be limited in a manner that is fair and reasonable in the circumstances, which may include repair, replacement, resupply or refund.

We do not guarantee that the website will always be uninterrupted or error-free, but we will take reasonable steps to maintain its operation and security.

21. Commercial-user indemnity

This section applies where a product or service is used for business or commercial purposes.

You indemnify Pubbets! against a substantiated third-party claim only to the extent that the claim is directly caused by:

  • your material breach of these Terms;
  • your unlawful use of a puppet;
  • Customer Materials you supplied without the necessary rights;
  • a false representation that your production is officially endorsed by Pubbets!; or
  • your infringement of another person’s legal rights.

This indemnity does not apply to the extent that a claim was caused or contributed to by Pubbets!’ own breach, negligence or unlawful conduct.

We will notify you of a relevant claim and provide a reasonable opportunity to participate in its defence or resolution.

22. Suspension and termination

We may suspend website access or terminate a licence granted under these Terms where reasonably necessary because of:

  • serious or repeated breach;
  • counterfeiting or unauthorised manufacturing;
  • fraud;
  • deliberate infringement of Pubbets! Intellectual Property;
  • illegal use; or
  • conduct creating an immediate material risk to Pubbets! or another person.

Where a breach can reasonably be corrected, we will ordinarily provide notice and a reasonable opportunity to correct it before terminating the licence.

Immediate action may be taken for fraud, counterfeiting, intentional infringement or serious illegal conduct.

Termination of an intellectual-property licence does not transfer ownership of the physical puppet back to Pubbets!.

23. Changes to these Terms

We may update these Terms to reflect changes in our products, business practices or legal obligations.

Changes apply prospectively from the date the updated Terms are published. The Terms in effect when you place an order will continue to govern that order unless:

  • a change is required by law;
  • the change benefits you; or
  • you expressly agree to the change.

We will not retrospectively remove or materially reduce usage rights already granted for a completed purchase merely by publishing new website terms.

24. Resolving concerns and disputes

If you have a concern, please contact us first at info@pubbets.net. We will make a genuine effort to understand the issue and find a fair solution.

These Terms are governed by the applicable laws of Australia, including the Australian Consumer Law, together with any applicable State or Territory law.

A dispute may be brought before any Australian court or tribunal that has lawful jurisdiction. Nothing in these Terms prevents a consumer from relying on mandatory rights or procedures available under the laws of their own location where those laws apply.

25. General provisions

If any part of these Terms is found to be invalid or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining provisions will continue to apply.

A delay in exercising a right does not waive that right.

These Terms, your order confirmation, any accepted quotation or build sheet, and any policies incorporated at checkout form the agreement between you and Pubbets! for the order.

The order of priority is:

  1. a separately signed or expressly accepted special agreement;
  2. an order-specific quotation, invoice or approved build sheet;
  3. these Terms; and
  4. other general website information.

You may not assign a commercial licence or special licensing agreement without our written consent. This does not prevent the ordinary resale or gifting of a physical puppet under Section 12.
